Property owners allege damages because of claimed lack of ordinance enforcement

BATON ROUGE – A Mandeville couple alleges that their property was damaged because ordinance codes were not enforced on the work of a neighboring property.

Marjorie Mary and Cameron Mary filed a complaint on May 16 in the U.S. District Court for the Eastern District of Louisiana against Patricia Brister, Gina Campo, Kelly Rabalais, Charles “Eddie” Williams and Paul Carroll alleging that they failed to comply with the parish's Net Fill Ordinance.

According to the complaint, the plaintiffs allege that as a result of defendants' violation of the ordinances, the direction of water flow caused significant damage to plaintiff's property in Mandeville. The plaintiffs holds Brister, Campo, Rabalais, Williams and Carroll responsible because the defendants allegedly failed to insure that the fill/excavation activities were permitted by the U.S. Army Corps of Engineers and any other relevant local, state or federal agencies.

The plaintiffs request a trial by jury and seek judgment against the defendants for damages suffered by plaintiffs, plus punitive damages, interest and all other general and equitable relief. They are represented by Randall A. Smith and J. Geoffrey Ormsby of Smith & Fawer LLC in New Orleans and Philip J. Kaplan of Law Offices of Philip J. Kaplan in Los Angeles, California.
