Man files suit against individuals, city of Bogalusa alleging false arrest

NEW ORLEANS – A man alleges that he was wrongfully arrested and incarcerated on warrants that were issued 20 years ago.

Fredrick Scott filed a complaint on May 19 in the U.S. District Court for the Eastern District of Louisiana against Darren Spears, Edward Gomez, the city of Bogalusa, et al. alleging that they violated the Fourth and 14th Amendments to the U.S. Constitution.

According to the complaint, the plaintiff alleges that on May 22, 2016, Spears transported the plaintiff to the Bogalusa City Jail on three felony warrants that were issued in 1996. The suit states that the plaintiff remained in custody until June 2, 2016, when he was bonded out. He alleges that he was never brought before a judge for a review of the warrants during his incarceration.

The plaintiff holds Spears, Gomez, the city of Bogalusa, et al. responsible because the defendants allegedly intentionally or negligently failed to remove the warrants from active status and falsely arrested and imprisoned plaintiff.

The plaintiff requests a trial by jury and seeks judgment against all defendants in solido in an amount deemed reasonable by the trier of fact, plus interest, all court costs and attorney's fees. He is represented by Brett J. Prendergast and Michael G. Riehlmann both in in New Orleans.
