The Heritage Marshall Foundation seeks distributions from The Peroxisome Trust

NEW ORLEANS – A Jefferson Parish man who is a co-trustee of a charitable foundation in the state alleges that it has not received more than $1 million in distributions.

Dr. Stephen D. Cook, as co-trustee of the Marshall Heritage Foundation, filed a complaint on May 30 in the U.S. District Court for the Eastern District of Louisiana against Preston L. Marshall, as co-trustee of the Peroxisome Trust, seeking declaratory and injunctive relief.

According to the complaint, the plaintiff alleges that the Marshall foundation suffered a shortfall in excess of $1,600,000 in the funds available for charitable donations and good works. The plaintiff holds Marshall responsible because the defendant allegedly failed to distribute the quarterly instalments due and payable to its beneficiaries.

The plaintiff requests a trial by jury and seeks an order directing defendant to effect past unpaid distributions to The Marshall Heritage Foundation and all other relief to which plaintiff is entitled.
