Seterus Inc. alleged to have failed to pay homeowners' property taxes

NEW ORLEANS – A St. Charles Parish couple alleges that a mortgage loan servicer was negligent in the servicing of their loan.

John and Linda Baxa filed a complaint on May 31 in the U.S. District Court for the Eastern District of Louisiana against Seterus Inc. alleging breach of promissory note and mortgage and negligent.

According to the complaint, the plaintiffs' mortgage is managed by Seterus and that the defendant failed to pay property taxes on the home in December 2015. As a result, the suit states the plaintiffs received a letter that from the St. Charles Parish Sheriff's Office that the property had been sold at a tax sale for delinquent taxes. The tax payment was later made, the suit states.

The plaintiffs also allege that the defendant later incorrectly calculated their escrow payment, failed to inform them of their new payment, and reported in May on their credit report that they were delinquent.

The plaintiffs seek all damages as are reasonable in the premises, with legal interest, attorneys' fees, costs of these proceedings and all further relief as the court shall deem necessary and proper. They are represented by David S. Moyer and S. Eliza James of David S. Moyer LLC in Luling.
