Environmental, Safety & Health Consulting Services Inc. alleges tank was not cleaned as contracted

NEW ORLEANS – A Houma environmental and industrial services contract alleges that a California corporation failed to clean a tank as contracted.

Environmental, Safety & Health Consulting Services Inc. filed a complaint on June 1 in the U.S. District Court for the Eastern District of Louisiana against Envent Corp. alleging breach of contract.

According to the complaint, Envent submitted a bid proposal to the plaintiff for a tank cleaning in March. The suit states the defendant began cleaning the tank on March 17, took longer to clean the tank than it estimated and was unable to complete the degassing services according to bid specifications.

The plaintiff holds Envent Corp. responsible because the defendant allegedly failed to perform tank degassing and venting services within the contracted period, failed to complete the agreed upon degassing services according to bid specifications and refused to allow the plaintiff to use water cannons during the degassing operations.

The plaintiff seeks an order finding defendant in breach of contract and liable for offset and damages, attorney’s fees and any other amounts plaintiff may be entitled. It is represented by Christopher H. Riviere, William N. Abel and Todd M. Magee of Riviere Law Firm in Thibodaux.
