Hammond Applebee's patron alleges greasy floor caused fall

BATON ROUGE – A Texas man alleges he was injured at a Hammond restaurant because of the wet and greasy condition of the restroom floor.

Edelmiro Guerra filed a complaint on June 12 in the U.S. District Court for the Middle District of Louisiana against Liberty Mutual Insurance Co. and Applebee's Restaurants LLC, doing business as Applebee's Grill and Bar, alleging negligence.

According to the complaint, the plaintiff alleges that on July 7, 2016, he was injured when he slipped and fell on the greasy floor in the men’s room at the Applebee’s Grill & Bar in Hammond. The plaintiff alleges has suffered pain and suffering, emotional anguish, loss of enjoyment of life, economic loss and medical bills because of the incident. 

The plaintiff holds Liberty Mutual Insurance Co. and Applebee's Restaurants LLC responsible because the defendants allegedly failed to take reasonable steps to correct the hazard.

The plaintiff requests a trial by jury and seeks judgment against the defendants jointly, severally and solidarily for all damages, plus legal interest, penalties and costs of these proceedings. He is represented by Eulis Simien Jr. and Jimmy Simien of Simien & Simien LLC in Baton Rouge.
