NEW ORLEANS – A Florida man alleges he was not compensated for security guard services he performed at a home improvement store.
Gary Kearney filed a complaint on June 14 in the U.S. District Court for the Eastern District of Louisiana against Home Depot USA Inc.; Kevin Fucich LLC, doing business as Falcon Security; and Point 2 Point Global Security Inc. alleging violation of the Fair Labor Standards Act and other counts.
According to the complaint, the plaintiff alleges that in October 2016, he provided security services for more than four full days without any relief at the Home Depot store in New Smyrna Beach, Florida. The suit states he was employed by Falcon Security, which was contracted by Home Depot and/or Point 2 Point.
The plaintiff holds Home Depot USA Inc., Kevin Fucich LLC and Point 2 Point Global Security Inc. responsible because the defendants allegedly failed to pay plaintiff for all hours worked, including overtime premiums, and failed to provide any food and hotel room or other accommodations.
The plaintiff requests a trial by jury and seeks an order allowing this case to proceed as a collective action, award of all unpaid wages, liquidated damages, attorney’s fees, costs, interest and penalties and all further relief as may be just and proper.
