NEW ORLEANS – A Jones Act seaman employed by a marine transportation business alleges he was injured while performing his duties as a deckhand near Vacherie.
Samuel R. Brister filed a complaint on June 22 in the U.S. District Court for the Eastern District of Louisiana against ACBL River Operations LLC alleging negligence.
According to the complaint, the plaintiff alleges that on March 11, he was working as a member of the crew of a vessel owned and/or controlled by the defendant when he sustained severe injuries to his lower back. He alleges he is permanently disabled from his marine employment and has suffered loss of income and employee benefits, disability and medical expenses.
The plaintiff holds ACBL River Operations LLC responsible because the defendant allegedly failed to adequately plan the operation, failed to provide proper equipment and failed to give appropriate warnings.
The plaintiff requests a trial by jury and seeks damages in the total sum of $2 million, plus interest, costs of these proceedings and all other general, equitable maritime relief. He is represented by Berney L. Strauss and Rhett E. King of Strauss & King APLC in New Orleans.
