BATON ROUGE – A surety company alleges it is owed more than $250,000 in connection with a construction project.
Berkley Regional Insurance Co. filed a complaint on June 22 in the U.S. District Court for the Middle District of Louisiana against Louisiana Housing Corp. alleging breach of contract.
According to the complaint, D. Honore' Construction Inc. (DHC) entered into a contract with the defendant for the Mid City Gardens construction project in 2010. The suit states the project was completed in 2012 and that the plaintiff sustained losses in the course of fulfilling its obligations and defending payment bond claims. On May 10, 2015, the plaintiff alleges it sent a demand to defendant for payment of the balance due under the contract in the amount of $291,356, but the defendant has failed to pay the amount.
The plaintiff seeks judgment against defendant in the amount of $291,356, plus interest, attorney fees, costs of these proceedings and all further relief as the court may deem just and proper.
