Couple files suit over alleged injuries sustained in collision with federal employee

Car accident 27

NEW ORLEANS – A couple alleges they were injured in Orleans Parish when a U.S. Postal Service employee struck their vehicle from behind.

Reginald Thompson and Audrill Thompson filed a complaint on June 29 in the U.S. District Court for the Eastern District of Louisiana against United States of America alleging negligence under the Federal Tort Claims Act.

According to the complaint, on April 15, 2015, the plaintiffs sustained serious injuries when a USPS employee struck them from behind at the intersection of Gentilly Boulevard and Frenchman Street in Orleans Parish.

The suit states the plaintiffs timely presented their claim to the appropriate federal agency, which was received by defendant on Oct 12, 2016, but that the defendant has not responded to the plaintiffs' administrative demand.

The plaintiffs hold United States of America responsible because defendant's employee allegedly failed to maintain proper control of the vehicle.

The plaintiffs request a trial by jury and seek judgment in plaintiffs' favor with legal interest, costs of these proceedings, and all other legal and equitable relief. They are represented by Matthew D. Hemmer of Morris Bart LLC in New Orleans.
