Disagreement over non-compete agreement leads to civil action in federal court

NEW ORLEANS - Sunbelt Rentals Inc. was sued in New Orleans federal court by a Tangipahoa Parish man who says that the company's non-compete agreements are too vague and unenforceable, according to documents filed on March 23.

Plaintiff Jason Daniel worked as a salesman for the defendant based out of Geismar. Daniel's employment included restrictive covenants, meant to prevent the plaintiff from soliciting customers from the company for one year after the termination of his employment.

The lawsuit says that, since the restrictive covenants do not list any parishes or municipalities that the plaintiff is restricted from competing against the company in, the agreement is unenforceable and invalid pursuant to Louisiana Law.

Daniel requests the court rule in favor of the agreement being invalid so that he may continue to work in a sales position for a competitor of the defendant, EquipmentShare.

The plaintiff is represented by Adams and Reese LLP.
