Woman sues Ouachita Parish sheriff's deputy, alleging excessive force

MONROE — A woman is requesting a jury trial against an officer that allegedly used unnecessary excessive force, unlawful arrest and personal property damage of persons.

Plaintiff Leslie L. Stuart filed a complaint on May 9, 2021 stating that on May 9, 2020, Timothy G. Fischer, Deputy Sheriff of Ouachita Parish, unlawfully detained her through use of excessive force and invaded privacies causing property damage, which is a violation of the Fourth and Fourteenth Amendment of the U.S. Constitution. 

According to the complaint, Deputy Fischer came to Stuart's residence inquiring about the whereabouts of one Mark Jones. Stuart proceeded to check for Jones then informed Deputy Fischer that Jones was not in the residence. Deputy Fischer allegedly drew his firearm, prompting Stuart to tell Fischer to leave her property. 

Stuart alleges that Deputy Fischer then used excessive force to place Stuart in handcuffs and in the back of his patrol vehicle. Deputy Fischer allegedly then later released Stuart from the vehicle but kept her in handcuffs, and once released from the handcuffs, she was issued a summons for "resisting an officer." 

The complaint further alleges that Deputy Fischer unlawfully entered Stuart's residence without a warrant for search or seizure and caused property damage while violating her privacy as he "rummaged about" the residence. 

Stuart is seeking a trail by jury of Deputy Fischer, compensatory damages and punitive damages, attorney's and court fees and any other equitable relief entitled to.
