General Motors is sued for wrongful death after father dies without help from airbags

GRETNA -- A woman is suing General Motors on behalf of two minor children for the alleged wrongful death of the children's father.

Courtney Brown, on behalf of two minor children, filed a complaint on May 16 in Jefferson Parish District Court against General Motors Company, LLC., General Motors Corporation, Top 2 Bottoms Motors, LLC, and XYZ Insurance Company for wrongful death.

According to the complaint, General Motors manufactured, sold and distributed a 2004 Chevrolet Tahoe owned by William H. Marks. On Sunday, June 21, 2020, Marks was traveling on Highway 3139 in the right lane, north on Clearview Parkway, when the vehicle came through the intersection and off the roadway over a water retention levee and down a ravine before striking the other side head-on, the suit says.

The Tahoe airbags showed to have not deployed, the suit says. Since the accident, General Motors has issued a recall addressing the airbag issue, the suit says. 

General Motors was notified in 2015 about the front airbag issues and did nothing about it, the suit claims. 

Brown is represented by Michael J. Riley, Sr.
