BATON ROUGE - Kathleen M. Wilson filed a complaint on November 1 in the U.S. District Court for the Middle District of Louisiana against Heineken USA for violation of the Louisiana Unfair Trade Practices Act, violation of state consumer fraud acts, breaches of express warranty, implied warranty of merchantability, Magnuson Moss Warranty Act, fraud and unjust enrichment.

According to the complaint, Heineken USA manufactures, labels, markets and sells Heineken 0.0 and promotes that the product does not contain alcohol. Wilson alleges that Heineken 0.0 does in fact contain .03% alcohol, making all marketing and labeling of the product fraudulent. Wilson alleges that the company advertises the product as alcohol-free which is a misrepresentation to sell more products to consumers under a false premise of not containing alcohol.

Wilson seeks a judgment permanently directing Defendant to correct its practices to comply with law, injunctive relief, monetary damages, statutory and/or punitive damages, cost of suit and attorney fees. Wilson is representing herself.
