Law firms fight over who can advertise being 'on your side'

LAFAYETTE - Laborde Earles Law Firm filed a federal lawsuit on December 3 in the Western District of Louisiana against Morris Bart, III and Morris Bart, LLC over their catch phrases.

According to the lawsuit, Plaintiff is a provider of legal services in various areas of the law and Louisiana markets. Plaintiff has been using the mark "We're Always On Your Side" for more than seven years in advertising its services. 

On Oct. 8, 2021, Defendants accused Plaintiff of infringing Defendants' trademark "I'm On Your Side" and was sued. 

Plaintiff seeks a judgment declaring: that the use of their phrase does not constitute trademark infringement, trademark dilution, or unfair competition under the Lanham Act; that Defendants are barred by the doctrine of laches from asserting claims of infringement against Plaintiff’s use of the mark; that they are not required to pay any amount of royalty or other costs to Defendant. Plaintiff is represented by Steven C. Lanza and Terry Joseph.
