Woman sues Delta Downs after elevator malfunction

LAKE CHARLES - Cheryl Lee filed a lawsuit in September in the Parish of Calcasieu District Court against Boyd Racing LLC d/b/a Delta Downs Racetrack Casino and Hotel, Boyd Louisiana Racing, LLC., Boyd Gaming Corporation and Schindler Elevator Corporation for negligence.

According to the lawsuit, which was recently removed to U.S. District Court for the Western District of Louisiana, on Oct. 5, 2020, Lee was on an elevator at the Delta Downs Racetrack Casino and Hotel when suddenly, without warning, the elevator malfunctioned, abruptly dropped and abruptly stopped, then continued to drop and stop abruptly. Lee was stuck in the elevator for approximately 45 minutes to an hour, the suit says.

Lee was caused to suffer cervicocranial syndrome, occipital headaches, concussion, cervical sprain, recurring nightmares, anxiety, elevated blood pressure, fear of during, post-concussion syndrome, depression, nervousness, nausea and upset, knee injuries, past, present and future pain and suffering, past, present and future lost wages, emotional stress and strain, loss of enjoyment of life and nursing care services. 

Lee sees an amount deemed reasonable by the court cost interest. Lee is represented by Darleen M. Jacobs.
