NEW ORLEANS – Shopper files injury lawsuit against Dillard Department Stores after allegedly tripping over a rack in the Slidell store and severely injuring herself.
Cheryl Bacon filed a lawsuit in federal court against Dillard Department Stores and ABC Insurance citing allegations of negligence.
According to court documents, on November 19, 2022, Bacon was shopping at a Dillard's store located at the Fremaux Town Center in Slidell and claims she tripped over a "z-rack" improperly placed between clothing racks in an aisle. She says this unsecured z-rack constituted an unreasonably dangerous condition.
The lawsuit claims Dillard breached its duty to maintain a safe environment for its customers and cites several forms of negligence, including failing to provide proper warning of the dangerous condition, properly inspect the premises, properly supervise employees and secure the premises adequately.
ABC Insurance Co. is named in the lawsuit as a defendant, with the lawsuit saying any claims against Dillard's are covered by insurance policies issued by ABC. Bacon contends that, under Louisiana law, ABC Insurance Co. is solidarily liable with Dillard's for the damages caused.
Bacon claims she sustained serious injuries to her right hip, which later required medical treatment. She is seeking damages for past and future medical expenses, loss of wages, physical and mental pain and suffering, physical disfigurement, disability and loss of enjoyment of life plus interest, attorney fees, court costs and any other relief the court deems proper.
