NEW ORLEANS — A Louisiana woman is suing General Motors alleging a vehicle she purchased was defective.
Tara M. Wills claims the vehicle she purchased, a 2022 Buick Envision Essence, was bought for personal use for $43,917.12 from Legacy Westbank Buick GMC in Louisiana, according to a complaint filed Nov. 28 in U.S. District Court for the Eastern District of Louisiana.
Since the purchase, Wills has experienced numerous defects with the vehicle and has returned it for repairs multiple times, but GM has failed to rectify the issues.
Wills claims that the defects in the vehicle qualify as redhibitory defects under Louisiana Civil Code Articles 2520.
Despite providing sufficient notice and opportunities for repair, Wills alleges that GM breached implied warranties of redhibition, according to the suit.
Wills claims the defendant has failed to repair the Envision, which constitutes a breach of the implied warranties of redhibition.
"The hidden defects, non-conformities and conditions in the Envision existed at the time of sale, but were not discovered until after delivery," the complaint states. "Neither Plaintiff nor a reasonable prudent buyer would have purchased the Envision had he or she known of the defects prior to the sale."
Wills is seeking rescission of the sale, return of the purchase price, collateral costs, finance charges, insurance premiums, out-of-pocket expenses and non-pecuniary damages. She is represented by Richard C. Dalton.
