NEW ORLEANS — C4 General Contracting is suing Neuromuscular Medical Association alleging breach of contract.
Dr. Fred DeFrancesch was also named as a defendant in the suit.
C4 is a contracting company that supplies repair and construction services for properties damaged by natural disasters, according to a complaint filed Nov. 22 in U.S. District Court for the Eastern District of Louisiana.
C4 claims it entered into two contracts with the defendant and the contracts involved the examination, investigation and repair of properties in LaPlace and Metairie, Louisiana, damaged by hurricanes.
NMA was obligated to present the plaintiff's bids to its insurance company to determine coverage for necessary repairs, according to the suit.
Despite the plaintiff completing its work in assessing damage and providing comprehensive reports, NMA, through DeFrancesch, repudiated the contracts and communicated an intent to leave their obligations unperformed.
NMA failed to permit the plaintiff to perform certain work and deposit funds received from insurance, making it impossible for the plaintiff to fulfill its obligations. Despite multiple attempts to secure performance, NMA stonewalled the plaintiff, according to the suit.
The plaintiff now seeks relief from the court, alleging breach of contractual obligations by NMA and DeFrancesch, leading to a denial of expected benefits and reimbursement for time, labor and materials expended in fulfilling their contractual duties.
The contracts were executed on Sept. 1, 2021, with specific conditions triggering the parties' obligations upon approval by NMA's insurance company, including payment and initiation of repair work.
The plaintiff is seeking compensatory damages. It is represented by Michael S. Blackwell, Robyn A. Brown and Hannah M. Marler of Riess LeMieux in New Orleans.
