United States of America sues Brian K. Whiteman for fraudulent transfer

In the United States District Court for the Western District of Louisiana, the United States of America has filed a lawsuit against Brian K. Whiteman, Robin McCoy Whiteman, and 3299 Bellevue Road, Haughton, Louisiana. The case ID is 5:24-cv-00502-TAD-MLH and it was filed on April 16, 2024. The lawsuit aims to void a fraudulent transfer under the Federal Debt Collection Procedures Act.

The U.S., represented by Brandon B. Brown and an unnamed Assistant U.S. Attorney, claims that Brian K. Whiteman owes them $2,183,949.76 due to a restitution judgment entered on October 6, 2023. It's alleged that Brian K. Whiteman transferred his property at 3299 Bellevue Road to his wife Robin McCoy Whiteman with intent to hinder the U.S.'s debt collection efforts.

The complaint states that Brian K. Whiteman fraudulently obtained money from Raeford Farms starting in January 2018 and was sentenced to 20 months in prison on October 2, 2023. Despite having been ordered to pay the aforementioned amount in restitution and a $100 assessment fee, as of April 16, 2024 he has only paid $150 towards his debt.

The plaintiff seeks judgment against the transferee of such property and requests the court to set aside this transfer of property.
