Leonard McMichael sues Monsanto Company for damages due to alleged exposure to Roundup

In the United States District Court for the Eastern District of Louisiana, plaintiff Leonard McMichael has filed a lawsuit against Monsanto Company. The case, identified as 2:24-cv-00965-EEF-KWR, was filed on April 17, 2024. The lawsuit alleges that Monsanto's herbicide Roundup®, containing the active ingredient glyphosate, is defective and dangerous to human health.

The plaintiff, Leonard McMichael, is representing himself individually and on behalf of his late wife Betty Ann McMichael. He asserts that her premature death was a direct result of exposure to Roundup and subsequent Non-Hodgkin’s lymphoma. Betty Ann McMichael was exposed to Roundup in Louisiana from approximately 1978 through 2003 and was diagnosed with Non-Hodgkin’s Lymphoma in approximately 2003.

The defendant, Monsanto Company, is a Delaware corporation with a principal place of business in St. Louis, Missouri. The company discovered the herbicidal properties of glyphosate and manufactured Roundup. It advertises and sells goods in the State of Louisiana and derives substantial revenue from interstate commerce.

McMichael seeks damages for injuries suffered as a direct result of Monsanto's negligent conduct in connection with the design, development, manufacture, testing, packaging, promoting, marketing, advertising, distribution, labeling, and sale of Roundup®. He maintains that the product is unfit for commerce due to its dangerous nature and lack of proper warnings about associated risks.
