Plaintiff with Disability Alleges Local Restaurant Operators Violate Accessibility Laws

Daniel Todd, a Louisiana resident with a disability, has filed a lawsuit against two companies for alleged violations of the Americans with Disabilities Act (ADA) and the Louisiana Commission on Human Rights (LCHR). The complaint was filed in the United States District Court for the Western District of Louisiana on November 18, 2024, targeting P & X Teng Inc. and Broussard Services, L.L.C., which operate Darrell’s Restaurant in Alexandria, Louisiana.

The plaintiff, Daniel Todd, claims that during his visits to Darrell's Restaurant at 1200 MacArthur Drive in Alexandria, he encountered several architectural barriers that hindered his access to the establishment. As a person who uses a wheelchair due to a missing leg, Todd alleges that these barriers include inaccessible parking spaces without an access aisle and blocked curb ramps. According to Todd's complaint, these conditions violate Title III of the ADA and the LCHR by denying him full and equal enjoyment of goods and services offered at the restaurant.

Todd's lawsuit emphasizes that he resides nearby in Winnfield, Louisiana, and frequently travels to Alexandria for medical treatment and other needs. He argues that until these barriers are removed or altered to comply with ADA standards, he is deterred from visiting Darrell’s Restaurant again. The plaintiff contends that removal of these barriers is readily achievable without placing an undue burden on the defendants.

In addition to seeking injunctive relief requiring P & X Teng Inc. and Broussard Services to make necessary modifications for accessibility compliance under federal and state laws, Todd is also pursuing compensatory damages for discrimination experienced due to his disability. Furthermore, he requests an award covering reasonable attorneys' fees and litigation costs incurred during this legal action.
