Plaintiff Alleges Major Automaker Breached Warranty Over Defective Vehicle

A Louisiana resident has taken legal action against a major automobile manufacturer, alleging that the vehicle he purchased was defective and that the company failed to honor its warranties. Paul Cormier filed a complaint in the United States District Court for the Eastern District of Louisiana on December 18, 2024, against General Motors, LLC.

The case centers around a 2024 GMC Canyon that Cormier bought from Maggio GMC on June 18, 2024, for $54,000. According to the complaint, Cormier experienced numerous defects with the vehicle shortly after purchase, including acceleration issues and transmission problems. Despite multiple attempts to have these issues repaired under warranty by General Motors and its authorized dealers, Cormier claims that significant defects remain unresolved. "The defects experienced by Plaintiff with the Subject Vehicle substantially impaired its use, value and safety," states the complaint.

Cormier's lawsuit is grounded in several legal claims. He alleges breach of express and implied warranties under both state law and the federal Magnuson-Moss Warranty Act. The plaintiff argues that General Motors failed to deliver a defect-free vehicle as promised in their warranty agreements. Furthermore, he accuses the company of violating Louisiana's redhibition laws by selling him a vehicle with hidden defects they knew or should have known about.

The plaintiff seeks various forms of relief from the court. These include rescission of the sales contract, return of the purchase price along with collateral costs such as finance charges and insurance premiums, compensation for out-of-pocket expenses related to repairs and loss of use, as well as damages for mental anguish. Additionally, Cormier requests attorney fees and litigation costs be covered by General Motors if he prevails in court.
