A Louisiana resident has filed a lawsuit against two medical device companies, alleging that their product caused him severe harm. Clinton Carrier Jr. initiated the complaint on December 20, 2024, in the United States District Court for the Western District of Louisiana against AngioDynamics, Inc., and Navilyst Medical, Inc.
Carrier claims that the defendants' LifePort Vascular Access Port, an implantable medical device designed to facilitate repeated access to the vascular system for treatments such as chemotherapy, was defectively designed and manufactured. The lawsuit accuses AngioDynamics and Navilyst of negligence, failure to warn consumers about potential risks, design defects, breach of both implied and express warranties, fraudulent concealment of known dangers, and violations of the Louisiana Unfair Trade Practices and Consumer Protection Law (LUTPA). According to Carrier's allegations, the LifePort device was prone to fracturing and causing infections due to its flawed design involving barium sulfate concentrations that compromised its structural integrity.
The plaintiff's legal action details how soon after the LifePort was introduced to market, numerous adverse event reports were submitted by healthcare providers noting fractures and migrations of the device within patients' bodies. Despite these reports and internal knowledge of these issues, Carrier alleges that AngioDynamics and Navilyst continued marketing the LifePort as safe without adequately warning physicians or patients about its risks. The complaint states that this omission led to serious injuries for Carrier after his LifePort implant in July 2014 resulted in infection by December 2015.
Carrier is seeking compensatory damages for pain and suffering along with economic losses due to medical expenses incurred from additional surgeries necessitated by complications from the LifePort device. The suit demands judgment against both defendants on all counts listed in the complaint. Additionally, it seeks damages under LUTPA for deceptive trade practices and requests pre-judgment interest as well as litigation costs.
