Darryl Harris has filed a lawsuit against his former employer, alleging violations of federal labor laws. The complaint was submitted by Harris on January 30, 2025, in the United States District Court for the Middle District of Louisiana against Barrow Creek, LLC, which operates as Made to Go Truckstop.
Harris claims that during his employment from October 2022 to September 2023 as a maintenance worker at Barrow Creek, he regularly worked more than forty hours per week without receiving appropriate overtime compensation. According to the Fair Labor Standards Act (FLSA), employers are required to pay employees one and a half times their regular rate for any hours worked over forty in a workweek. However, Harris alleges that instead of receiving overtime pay, he was only compensated at his regular hourly rate for extra hours worked beyond forty each week. For instance, during the week of March 27 to April 2, 2023, Harris worked fifty-nine hours but was paid only for forty hours at $9 per hour with no overtime premium. He further asserts that this practice continued despite numerous complaints and that Barrow Creek's actions were willful violations of the FLSA.
Harris is seeking several forms of relief from the court. He requests an order holding Barrow Creek liable for unpaid overtime wages and liquidated damages equal to those unpaid wages. Additionally, he seeks compensation for legal costs and attorneys' fees associated with bringing this action under the FLSA. Harris also asks for pre- and post-judgment interest on any awarded amounts and any other relief deemed necessary by the court.
