Plaintiff alleges negligence against healthcare provider after unsupervised resident attack

Laurie Allen has filed a lawsuit against Brightspring Health Services, alleging negligence that resulted in personal injuries and mental anguish. The complaint was filed on March 11, 2025, in the United States District Court for the Eastern District of Louisiana.

The case revolves around an incident that occurred on June 10, 2024, at a group home operated by Brightspring Health Services located at 1205 Loch Lomand Drive in Harvey, Louisiana. Laurie Allen claims she was attacked by an unsupervised resident while visiting the facility as a business invitee. The attack left her with severe injuries to her shoulder, hand, body, and mind. Allen accuses Brightspring Health Services of failing to provide adequate supervision and control over its residents, leading to her injuries. She asserts that there was no staff member present to prevent or mitigate the attack when it occurred.

According to the complaint, Allen alleges several specific failures on the part of Brightspring Health Services: failure to protect her from dangerous residents; inadequate training and staffing; failure to maintain safe conditions as required by Article 660 of the Louisiana Civil Code; and failure to warn her about existing dangers on the property. These allegations form the basis of her claim that Brightspring's negligence directly caused her physical and emotional suffering.

Allen is seeking a jury trial and requests judgment against Brightspring Health Services for damages exceeding $75,000. She seeks compensation for past, present, and future pain and suffering; mental anguish; medical expenses; loss of earning capacity; and lost wages. Additionally, she asks for a court order requiring Brightspring Health Services to properly maintain their premises moving forward.

The case is being handled by attorney Jonathan Forstall from New Orleans. The complaint has been served through the Louisiana Long Arm Statute due to Brightspring's Kentucky domicile. The presiding judge for this case is yet unnamed but will be handling Case ID 2:25-cv-00470.
