The complaint was filed on March 10, 2025, in the United States District Court for the Eastern District of Louisiana. The lawsuit alleges that a Baseus Magnetic Power Bank Battery Pack purchased from Amazon.com ignited while in use, causing significant damage and injuries.
According to the complaint, Tori Davis purchased the power bank on March 5, 2024. Just four days later, on March 9, 2024, the device caught fire while plugged into her vehicle's USB port. At the time of the incident, Davis's minor children were inside the vehicle. While two of her children managed to escape with minor injuries, her daughter Keyia sustained a broken hand and other injuries as she struggled to exit the burning car. This terrifying event is at the heart of Davis's legal action against both Amazon and Baseus.
The lawsuit details multiple allegations against the defendants under various federal and state laws. Davis accuses them of violating consumer safety regulations by failing to report known defects in their product as required by law. She cites violations under the Consumer Product Safety Act (15 U.S.C. § 2051 et seq.), Federal Trade Commission Act (15 U.S.C. § 41 et seq.), and Magnuson-Moss Warranty Act (15 U.S.C. § 2301 et seq.). Furthermore, she asserts claims under Louisiana state law for products liability and negligence due to design flaws and failure to warn consumers about potential hazards.
Davis is seeking compensatory damages for medical expenses incurred due to her children's injuries, emotional distress suffered by her family, loss of personal property including their vehicle, and economic losses resulting from this ordeal. Additionally, she demands civil penalties under federal law for deceptive trade practices and breach of warranty claims related to false advertising about product safety.
