In a dramatic legal confrontation, a Louisiana resident has taken on a major automotive giant over alleged defects in his newly purchased vehicle. Darren Ferrier filed a complaint against General Motors, LLC in the United States District Court for the Middle District of Louisiana on March 14, 2025. The lawsuit accuses General Motors of selling a defective 2023 GMC Sierra 1500 and failing to honor warranties under both federal and state laws.
The case revolves around Ferrier's purchase of the vehicle from Ross Downing Buick GMC of Gonzales on March 6, 2023. The transaction was supposed to be backed by both implied and express warranties guaranteeing the vehicle's quality and performance. However, Ferrier alleges that soon after the purchase, he encountered significant issues with the vehicle's engine and transmission systems. On August 27, 2024, he reported losing power while driving, accompanied by an illuminated engine malfunction indicator. Despite multiple repair attempts by authorized service dealers, including a lengthy 64-day period for initial repairs and another ten days for subsequent issues in December 2024, the problems persisted.
Ferrier's complaint highlights violations of the Magnuson-Moss Warranty Act and Louisiana Redhibition Laws. He argues that General Motors breached both implied warranties of merchantability and express warranties provided at the time of sale. According to Ferrier, these breaches have substantially impaired the use, value, and safety of his vehicle. "No reasonable buyer would have purchased the Vehicle had they known of the defects before sale," asserts Ferrier in his complaint.
Seeking justice through rescission of the sales contract, Ferrier demands not only a refund of his purchase price but also compensation for all collateral costs incurred due to these alleged defects. This includes finance charges, insurance premiums, maintenance costs, repair expenses, as well as attorney fees if he prevails in court. Furthermore, Ferrier seeks damages exceeding $75,000 for what he describes as deceptive practices by General Motors.
