In a significant legal move, an individual with disabilities has taken action against two businesses in Louisiana for alleged violations of the Americans with Disabilities Act (ADA) and state human rights laws. Daniel Todd filed a complaint on April 9, 2025, in the United States District Court for the Western District of Louisiana, Alexandria Division, targeting Louisiana Capital Investors, Inc. and DQ Enterprises, LLC. The case centers around accessibility issues at a Dairy Queen Grill & Chill located in Alexandria.
Daniel Todd's lawsuit is rooted in his experiences as a person living with a disability—specifically, he is missing a leg and relies on a wheelchair for mobility. According to the complaint, Todd encountered numerous architectural barriers during his visit to the Dairy Queen property at 737 MacArthur Drive. These barriers include the absence of designated accessible parking spaces, an entrance ramp with an impermissible slope, restrooms located up two steps without ramp access, and narrow restroom doors that hinder accessibility. Todd argues that these conditions violate Title III of the ADA and the Louisiana Commission on Human Rights (LCHR), which mandates equal access to public accommodations.
The plaintiff contends that these barriers deter him from visiting the property despite its proximity to his residence—less than five miles away—and that they deny him full enjoyment of services offered to the general public. He asserts that removing these barriers is readily achievable and would not impose undue hardship on the defendants. The lawsuit seeks declaratory and injunctive relief to compel compliance with ADA standards, compensatory damages under LCHR provisions for discriminatory practices based on disability, and coverage of attorney fees and costs incurred due to this legal action.
Todd's legal representation comes from Bizer & DeReus LLC based in New Orleans. Attorneys Andrew D. Bizer, Garret S. DeReus, and Eva M. Kalikoff are advocating on behalf of Todd in this case identified as Case No.: 1:25-cv-00459 before unnamed judges in the Western District of Louisiana.
