A Macy's customer claims to suffer from post-traumatic stress after sitting in a chair that broke at a Lafayette store.
Edward Hill, Jr. says he was shopping on Aug. 24, 2009, when he decided to rest and sat in a store chair. After he sat down in the chair, it broke.
Hill states he fell down and aggravated preexisting injuries including his left hand and post traumatic stress disorder, according to a negligence suit filed March 5 in the Eastern District of Louisiana.
He alleges Macy's is negligent for failing to provide him with a safe and suitable chair, failing to adequately inspect the chair, and failing to train or supervise its personnel in the performance of their duties.
Hill claims Macy's knew or should have known the chair was defective and unsafe at the time it was provided to him.
New Orleans attorney Berney L. Strauss of Strauss & King, APLC is representing Hill.
Hill wants Macy's to pay more than $350,000 in damages for physical pain and suffering, mental and emotional pain and suffering, medical expenses, loss of enjoyment of life, interest and court costs.
Jury trial requested.
U.S. District Judge Carl Barbier is assigned to the case.
