Property owners sue city, water board over canal flooding

The Sewerage and Water Board of the City of New Orleans is liable for extensive property damage due to flooding at a canal, according to a suit filed against the board and city in Orleans Parish District Court on March 3.

The suit, filed by New Orleans attorney Michael Rodriguez on behalf of Terrance and Nykita Burton, alleges that "each and every time that there is a heavy rain, the said drainage ditch and/or canal have overflowed causing damage to your petitioner' house, shed, property, equipment, clothes and belongings."

The property, which is located in New Orleans East, lies adjacent to a canal that the "City of New Orleans, Sewerage & Water Board of New Orleans, and the City of New Orleans Department of Public Works, constructed, cleared, rebuilt and have attempted to maintain and repair," the suit says.

The plaintiffs claim the city of New Orleans and the Sewerage and Water Board of New Orleans are "liable for the original costs of all damaged goods and property," which includes the petitioners' house, shed and yard.
