A Terrabone Parish woman says she was injured while visiting a casino.
Rachel Hills filed her complaint last month in Jefferson Parish District Court against Treasure Chest Casino LLC and Boyd Gaming Corporation. The defendants removed the case to federal court on April 30.
According to the original complaint, Hills was visiting the riverboat casino located on Lake Pontchartrain on April 13, 2024, when she slipped and fell in the ladies’ room and sustained injuries.
In the complaint, Hills said she slipped on a slippery substance on the restroom floor. She says a casino employee assisted her in getting up, but she fell again.
She says the floor and walking areas of the restroom were slippery and unsafe because of the actions or inactions of the casino and its staff.
Hills says she suffered injuries to her neck and back that radiated into her upper and lower extremities. She says she has incurred medical expenses of nearly $17,000 and expects more as treatment continues.
She says she was in good health and employed by Lowe’s as a delivery coordinator. Since the incident, she says she has been disabled from her employment and has past lost wages in the amount of $45,000.
Hills seeks compensatory damages for past and future medical expenses, past lost wages, impairment of her future earning capacity, loss of employment benefits, past and future physical and mental pain and suffering, loss of enjoyment of life as well as permanent impairment and disability. She also seeks interest, expert fees, taxable costs and other general and equitable relief.
In the casino’s April 30 notice of removal, it says the complaint should be handled in federal court because Boyd Gaming is based in Nevada. Thus, complete diversity exists.
