Pedestrian sues after being hit by vehicle

Janell Michel of Orleans Parish filed suit in Orleans Parish District Court in April claiming she was struck and seriously injured by a car operated by Leola Hicks.

Michel's suit against Hicks and Geico Indemnity claims she was carefully attempting to cross the street near the intersection of St. Charles Avenue and Foucher Street on April 21, 2009, when the incident happened.

Michel claims Hicks is negligent for traveling at an unreasonable rate of speed, failing to act as a reasonable and prudent person should, failing to yield the right of way to pedestrian, failing to use care and caution, failing to maintain a proper lookout and failing to maintain proper control of her vehicle.

She is seeking damages for medical expenses, physical pain and suffering, mental anguish, emotional distress, legal interest and court costs.

Metairie attorneys Kevin Larmann and Shailendra Kulkarni of Hailey, McNamara, Hall, Larmann & Paple are representing Michel.

Judge Sidney H. Cates, IV is assigned to the litigation.
