Woman slips at Winn-Dixie, sues store

NEW ORLEANS-While shopping at the Winn-Dixie on Pontchartrain Boulevard in Slidell, Myrtle Terrell claims she slipped on a wet substance and did a split backwards into a wall, causing serious injuries.

Terrell states that the injuries are severe, painful and disabling.

Accusing the store and its employees of negligence, Terrell filed suit against Winn-Dixie and XYZ Insurance Co. on May 19 in the federal court in New Orleans.

The incident occurred around 2:30 pm. June 12, 2009, according to the suit.

Terrell states her injuries were caused by the defendants negligence in failing to properly maintain its premises, failing to warn its guests of known hazards and dangerous conditions, failing to adequately inspect the property, creating and failing to correct the known defective and hazardous condition and failing to properly oversee its employees.

The lawsuit states that Winn-Dixie's acts of negligence placed their guests in a "perilous situation by lack of inspection and/or maintenance."

Terrell is seeking damages for physical and mental pain and suffering and disability, medical expenses, lost wages, scarring and disfigurement, court costs and legal interest.

New Orleans attorney John D. Sileo is representing Terrell in her allegations.

U.S. District Judge Helen G. Berrigan is assigned to the case.
