Louisiana family sues Florida renovator over defects in house

A Louisiana family is suing a Florida renovator for major defects in their newly-renovated home.

Matthew D. Hughes and Jan R. Hughes, individually and on behalf of their two minor children, filed suit against Rogers Company June 4 in federal court in New Orleans.

The defendants renovated the Meraux, La. home after it was damaged by Hurricane Katrina. The renovations were completed and the couple bought the house July 31, 2008 for $167,000.

The Hughes say the home is full of redhibitory defects that include an air conditioning system that does not work properly, corroded air conditioning coils that need to be replaced despite being only two-years-old, corroded copper piping and wiring.

The couple says the defects make the home unfit and useless as a residence.

Causes of action filed against the defendant include unjust enrichment, redhibition and breach of express warranty and negligence.

The plaintiffs are seeking more than $75,000 in damages for damage to real and personal property, physical and mental pain and suffering, emotional distress, fear and fright, loss of enjoyment of life, medical expenses, interest, attorneys' fees and expenses along with court administrative costs.

New Orleans attorneys Russ Herman, Leonard Davis, Stephen Herman and Jeremy Epstein of Herman, Herman, Katz & Cotlar are representing the Hughes.

U.S. District Judge Eldon E. Fallon is assigned to the case.
