A Mississippi resident is suing a helicopter courier service for insisting to transport him in severe and dangerous weather.
James Austin Peak, who was struck by lightning while entering a helicopter, filed suit against PHI Inc. on Aug. 12 in federal court in New Orleans.
The accident occurred on Aug. 12, 2009 as he was about to be transported to shore form a platform off the coast of Louisiana in the Gulf of Mexico.
Peak claims the defendant insisted the workers be loaded into the helicopter while it was storming.
PHI is accused of negligent navigation and operation of a helicopter, operating the helicopter in severe weather, failing to prevent injury to the passengers of its helicopter and failing to warn Peak.
Peak is seeking damages for physical pain and suffering, mental pain, suffering and anguish, medical expenses, lost wages, loss of future earning capacity, loss of fringe benefits, loss of enjoyment of life, interest, court costs and attorney's fees.
Peak is represented by Gretna attorneys Ronna M. Steele and Alaraby Johnson.
U.S. District Judge Jay C. Zainey is assigned to the case.
