Defense counsel seeks the dismissal of a doctor named in a medical malpractice suit in Orleans Parish Civil District court.
Orleans Parish resident Lindsay Broussard is suing Samuel Alexander, M.D., the Medical Center of Louisiana at New Orleans (Charity Hospital), the Louisiana State University and the Department of Health and Hospitals in relation to her mother's death due to complications after a car accident.
Metairie attorney Anthony Glorioso filed the original petition for damages in April 2009.
The lawsuit claims Broussard's mother, Lisa Broussard, sought medical attention at Charity Hospital after a December 2003 car accident. She was diagnosed with a broken sternum and bruised torso and released.
Three days later, the suit claims, Lisa Broussard visited her gynecologist, Dr. Alexander, who prescribed her laxatives for her abdominal swelling. Four days later, Broussard was admitted to East Jefferson General Hospital where she was diagnosed with a perforated small bowel, underwent surgery and later died.
In January 2009, a medical review panel heard Lindsay Broussard's claims of medical malpractice against the defendants and found that there was no breach in the standard of care.
Metairie attorney Harvey Godofsky is representing Dr. Alexander.
Godofsky filed a motion for summary judgment seeking Dr. Alexander's dismissal as a defendant in this case based on the medical review panel's findings, and that plaintiff "does not have any expert to testify that Dr. Alexander breached any standard of care or caused damages."
Orleans Parish Judge Sidney Cates is overseeing this case.
