Woman sues after slipping and falling at Texas Roadhouse

A St. Tammany Parish resident has filed a lawsuit against Texas Roadhouse restaurant after allegedly sustaining injuries during a slip and fall incident.

Teresa Augustine filed suit against Texas Roadhouse Inc. and XYZ Insurance Co., as liability insurer for Texas Roadhouse, on Jan. 8, in St. Tammany Parish District Court. The defendant removed the case to New Orleans federal court on Sept. 27.

The incident occurred on Aug. 15, 2009 as Augustine was walking to the restroom in the Texas Roadhouse located in Slidell. She states she slipped near the bar area due to two different types of flooring installed in and right outside the bar area. Augustine states she sustained serious injuries from the fall and will likely undergo knee surgery.

The defendant is accused of failing to observe due caution, failing to provide a suitable walking area for customers leaving the bar area, failing to attend to an unsafe condition, failing to provide immediate medical care, inattention to a potential hazard, presenting an unreasonable and foreseeable risk of harm, and failing to provide a sign to warn patrons of the difference in flooring upon walking in and out of bar area.

Augustine is seeking damages for physical pain, suffering, disfigurement, mental anguish, aggravation, annoyance, disability, medical expense, lost wages, loss of enjoyment of life, loss of use/function of parts of body, bodily disability, impairment of psychological functioning, disability limiting work to earn an income, destruction of earning capacity, disability from engaging in recreation, interest and court costs.

She is represented by Georgia G. Turgeau of Turgeau Law Firm in Slidell.

U.S. District Judge Lance M. Africk is assigned to the case.
