Mold in Metairie rental made woman sick, suit claims

A Jefferson Parish woman is suing her former landlord, claiming mold in a Metairie rental house made her sick.

Mary E. Dawson filed the lawsuit against Ida Stone and her insurance provider, XYZ Insurance Company, on Oct. 4 in Orleans Parish District Court.

Dawson says she was renting a house from Stone when Hurricane Katrina hit in August 2005. Dawson moved out of the house in Metairie while it was being repaired. When she moved back in, Dawson says she was told the house was safe.

Shortly after returning to the house, Dawson claims she became sick with respiratory problems. A test performed in October 2009 showed mold in the HVAC system. Dawson says Stone should have known about the mold and should have had it removed while the house was being repaired.

Dawson accuses Stone of negligence. She is seeking an unspecified amount of money for pain and suffering, medical expenses and court costs.

Attorney Wayne W. Yuspeh of Metairie is representing Dawson. They are asking for a jury trial.
