Dieter claims Slim-Fast caused stomach problems

A Louisiana resident has filed a lawsuit against the manufacturers of the diet supplement Slim-Fast after he suffered stomach blockages.

Claiming the Slim Fast drinks were contaminated, Junius Roussell Jr. filed suit against Unilever United States Inc. on Oct. 15 in federal court in New Orleans.

Roussell states he decided to go on a diet in July 2009 and purchased Slim-Fast Ready to Drink Shakes. He claims he sought medical attention in September for throat problems but since he was ill, he continued to drink the Slim-Fast as a meal supplement. He states he grew more ill and was admitted into the hospital for a septic throat in Oct. 2009.

According to the lawsuit, Roussell started to suffer from stomach problems in December 2009 and it was discovered he had a stomach blockage that required surgical stints.

In December, Roussell received a letter from Sam's Club stating that the Slim-Fast he had purchased was recalled.

The defendant is accused of negligence for failing to exercise ordinary care to procure food products from a supplier who handled the food products properly and failing to properly handle, inspect and prepare food products. Unilever is also accused of negligence for failing to reasonably adequately inspect its facilities for unclean conditions, failing to require its food handlers to observe hygienic practices, failing to give adequate warnings regarding possible pre-existing contamination and failing to provide adequate policies regarding the inspection and preparation of its products.

Roussell also accuses the defendant of negligence per se, strict liability, breach of implied and express warranty of fitness for human consumption, violations of the Louisiana Deceptive Trade Practices Law and malice.

The plaintiff is seeking damages for medical expenses, physical pain and mental anguish, punitive damages, interest and court costs.
