A Tangipahoa resident has filed a lawsuit against Wal-Mart for allowing water to be sprayed onto the floor, resulting in a slip and fall incident.
Elaine Johnson filed suit on Oct. 4 in Tangipahoa Parish District Court, and the case was removed to federal court in New Orleans on Oct. 26.
The accident occurred on Nov. 4, 2009 as Johnson was shopping in the produce area of the Wal-Mart store located in Hammond. She claims she slipped and fell in water that was on the floor.
Wal-Mart is accused of allowing the water to be sprayed onto the floor from the watering system located in the produce department.
Johnson is seeking more than $12,000 in damages for medical expenses, lost wages, plus interest and court costs.
According to the defendant's request for removal, the alleged damages for the case are expected to exceed $75,000 as Johnson is currently undergoing medical treatment for the injury to her shoulder and surgery is recommended.
Johnson is represented by New Orleans attorney Kevin C. Schoenberger.
U.S. District Judge Eldon E. Fallon is assigned to the case.
