Seaman sues for $2 million after falling due to inadequate lighting

A seaman is suing his employer for $2 million after he injured his lower back when he fell due to what he claims was inadequate lighting.

Jerry Kirkley filed suit against Deloach Marine Services Inc. on Oct. 28 in federal court in New Orleans.

The accident occurred on Nov. 23, 2009 as Kirkley was working as an unlicensed engineer and crewmember of the M/V Poseidon, a towing vessel working in the Intracoastal Waterway near Plaquemine. Kirkley states that he was assisting the deckhand in building tow when he severely injured his lumbar spine when he fell to the deck of the tow.

Kirkley claims his injuries were caused by the defendant's negligence regarding inadequate lighting, inadequate or faulty equipment, insufficient manpower, insufficient supervision and unsafe work environment.

He is seeking more than $2 million in damages for physical pain and suffering, mental anguish, emotional distress, medical expenses, permanent disability, disfigurement, lost wages, loss of earnings, loss of enjoyment of life, maintenance and cure, interest, attorney's fees and punitive damages.

U.S. District Judge Jay C. Zainey is assigned to the case.
