A Terrebonne resident is suing J.C. Penney after she slipped in water and fell.
Gwendolyn Adams filed the suit Oct. 11 in Terrebonne Parish Judicial District Court. The case was removed to federal court in New Orleans on Nov. 4.
The accident occurred on Oct. 10, 2009 as Adams was shopping in the J.C. Penney store in Houma. Adams states she slipped and fell on the wet floor because there were no warning signs or anything to alert her as to the hazardous condition of the floor.
The defendant is accused of failing to maintain the premises in a reasonably safe condition, failing to warn of the existence of a dangerous condition, failing to warn patrons of the existence of a wet floor and failing to place warning signs.
J.C. Penney is also accused of failing to adequately train personnel on how and where to place warning signs and on how to warn patrons of the existence of a wet floor and for failing to exercise the degree of care commensurate with the situation.
The plaintiff is seeking damages for medical bills, physical pain and suffering, mental pain and suffering, loss of wages, loss of earning capacity, loss of enjoyment of life, interest and court costs.

U.S. District Judge Jay C. Zainey is assigned to the case.
