Fastrac Urgent Care sued over lease agreement

A New Orleans property owner has filed a lawsuit against the owner of an urgent care facility which allegedly abandoned a lease two years early.

Patrick's Place East LLC filed the lawsuit against Fastrac Urgent Care Inc, Fasttrac Urgent Care Medical Center and Tamla Thomas Pierre on Nov. 15 in Orleans Parish District Court.

The owners of Patrick's Place East say they entered into a lease agreement with Fastrac Urgent Care and Pierre in April 2009.

Patrick's says Fastrac agreed to rent the property at the corner of Bullard Avenue and Levy Drive in New Orleans for 36 months. The rent was set at $4,000 for the first 24 months and $4,500 for the remainder of the lease.

Patrick's claims the defendants abandoned the Bullard Avenue property in October. In addition to leaving without notice, Pierre allegedly removed medical equipment, office supplies and furniture that had been provided by Patrick's.

Patrick's says Fastrac and Pierre failed to make the $4,000 rental payment that was due on Nov. 1. The property owner contends the defendants owe the entire balance due under the lease, along with 15 percent in penalties, attorney fees and court costs. They are also asking to be reimbursed for all of the equipment and furniture Patrick's says was illegally removed from the premises.

Attorney Jon G. Bethune, of New Orleans, is representing Patrick's Far East.

Orleans Parish case no. 10-L-11536.
