Disabled man sues Churchill Downs for better accommodations

A disabled man has filed a lawsuit against Churchill Downs Louisiana Horseracing Co. in an effort to obtain better access to the casino.

David Price filed suit on Nov. 11 in federal court in New Orleans.

Price qualifies as disabled under the Americans with Disabilities Act as he is paralyzed from the waist down because of a motorcycle accident, the complaint states.

Among other things, Price claims that the route from the parking lot to the casino lacks proper handrails and the front desk and other counters are not accessible throughout the property due to excessive heights.

Price is asking the court to declare that the property is in violation of the Americans with Disabilities Act, direct the defendant to alter the facility to make it accessible for individuals with disabilities and for an award of attorneys' fees and court costs.

The plaintiff is represented by New Orleans attorney Georgianne Sims and the Miama law firm Ku & Mussman.

U.S. District Judge Ivan L. R. Lemelle is assigned to the case.
