A New Orleans engineering firm is being accused of failing to pay one of its consultant's overtime compensation in a recently filed lawsuit.
Claiming violations of the Fair Labor Standards Act, Sue D. Bonderson filed suit against Three Fold Consultants on Dec. 1 in federal court in New Orleans.
Bonderson states she was an hourly employee and paid at an hourly rate of $40 per hour. She claims that when she was hired it was explicitly understood that she would be paid this hourly rate and about 20 additional hours paid at an overtime rate of $60 per hour. Bonderson states she did not agree to a fixed amount of compensation per year.
According to the lawsuit, during her employment, Bonderson regularly worked in excess of 40 hours per week. She accuses Three Fold Consultants of failing and refusing to compensate her at the minimum hourly rate to which she is entitled.
The plaintiff is seeking an award of monies owed and an award of liquidated damages, plus interest, court costs and attorneys' fees.
Bonderson is represented by Covington attorney Dale E. Williams. A jury trial is requested.
U.S. District Judge Lance M. Africk is assigned to the case.
