Defense exception denied in lawsuit against Entergy

Orleans Parish Civil District Court Judge Herbert Cade denied a defense motion of exception for prescription in a suit filed against Entergy over a blown transformer that allegedly damaged a nearby Laundromat.

Helen Chin owns the Cleanerama Laundromat and is suing Entergy for allegedly damaging her business' electrical equipment when repairmen blew out a transformer in early December 2008.

New Orleans attorney Marc Frischhertz filed the original petition for damages in March 2010.

New Orleans attorneys Marcus Brown and Alan Katz are representing Entergy. Their motion stated that the plaintiff's claims are subject to "prescription of one year, which commenced to run on December 6, 2008."

Chin claimed she filed a claim through Superior Claim Services Inc. after the accident and that Entergy acknowledged the damage, but she has not heard from them since.
