An oil platform worker has filed a personal injury lawsuit against his employer for failing to take proper safety precautions.
Barry Bennett Jr. filed suit against John Doe, Hudson Services Inc. and Shell Oil Co. on Dec. 16 in St. John the Baptist Parish. The defendant removed the case to federal court in New Orleans on Jan. 18.
The accident occurred on Jan. 10, 2010 as Bennett was working on a platform owned by Shell Oil. He states he suffered severe and permanent disabling injuries when a binding chain attached to a casing saw broke loose and struck Bennett across his shoulder and chest.
The defendants are accused of failing to keep the premises safe, failing to instruct their employees as to the proper handling/operating and use of machinery and equipment, failing to take measures to not endanger an innocent party, failing to use proper equipment/machinery to protect against this type of risk, failing to properly monitor and supervise their employees and worksite and failing to take proper safety precautions.
The plaintiff is seeking damages for physical pain and suffering, mental pain and suffering, property damage, medical expenses, loss of earnings, loss of earning capacity, permanent disability, interest, and court costs.
He is currently receiving workers compensation benefits.
