Winn-Dixie customer sues after slip and fall

A Winn-Dixie customer is suing a Hammond store after she slipped in water and fell, sustaining a fracture to her wrist.

Delores Hartford filed suit against Winn-Dixie Montgomery on Jan. 20, 2011 in Tangipahoa Parish District Court. The defendant removed the case on Feb. 24 in federal court in New Orleans.

Hartford states she slipped and fell from water that had pooled in front of the automatic entrance doors on Feb. 4, 2010. The fall caused Hartford to fracture her risk and injure her neck and back, the suit claims.

The defendant is accused of negligent for failing to keep its floor clean, dry and hazard-free, failing to provide warnings of a hazardous condition, failing to provide adequate matting and failing to utilize adequate maintenance and inspection procedures.

Hartford is represented by New Orleans attorney John L. Young.

U.S. District Judge Carl J. Barbier is assigned to the case.
