Texas Roadhouse sued over handicap ramp

A Harvey restaurant is being sued by a Jefferson Parish resident for not providing an adequate handicap ramp.

Jane Costanza filed suit against Texas Roadhouse Inc. on Jan. 26 in Jefferson Parish District Court. The defendant removed the case to federal court in New Orleans on March 1.

According to the lawsuit, Costanza was injured on April 1, 2010 due to a "dangerous condition" at the restaurant.

Costanza claims she seriously injured her head, brain and body.

The defendant is accused of negligence for failing to provide an adequate handicap ramp for ingress and egress to the property, failing to inspect the premises, failing to provide safe conditions and for failing to warn of dangerous conditions.

Costanza is seeking damages for mental and physical pain and suffering, emotional distress, impairment of ability to enjoy life's pleasures, medical expenses, interest and court costs.

The plaintiff is represented by New Orleans attorney Laurence Cohen.

U.S. District Judge Lance M. Africk is assigned to the case.
